From mancipatio to emancipation in Roman law
- Date de la conférence: vendredi 8 avril 2022
What do you get when you add three mancipatios and three manumissions?
Answer: one emancipation. Roman law combined an authoritarian vision of the family (and of the State) with a reverence for legal forms handed down from the distant past. Both of these characteristics are evident when we consider how emancipation took place before the time of Justinian. Looking at the old Roman rules helps us to gain perspective on the long evolution from parental rights to parental powers.
Content warning: this seminar will include some discussion of the Roman law relating to enslaved persons.
